Procedural Fairness

The “right to be heard” is an important factor considered by IRCC when making a decision on an application. When a decision will have a considerable effect on the individual, IRCC provides a fair opportunity to respond by issuing a Procedural Fairness Letter. Appeals to Immigration Appeal Division (IAD)

Authorization to Return to Canada (ARC)

If a foreign individual has been "asked" to leave Canada, depending on the measures taken to ensure that the foreign national leaves, an Authorization to Return to Canada may or may not be required. Authorization to Return to Canada is always required in cases of a previous Deportation order and may be required in cases of an Exclusion and Departure order.

Criminal Inadmissibility & Rehabilitation

If an applicant has been found criminally inadmissible to Canada, before they can visit or come to Canada permanently, the individual in question will have to be "rehabilitated". An individual will be considered "rehabilitated" when immigration authorities are satisfied that this individual is not likely to become involved in any new criminal activity. In some cases "rehabilitation" is deemed (when certain requirements are met) and in some cases a rehabilitation application must be submitted for determination to the immigration authorities.
